The inclusion of Justice Ijaz ul Ahsan as member in Supreme Judicial Council (SJC) in the matter of proceedings against Justice Mazahar Ali Naqvi has been challenged in Supreme Court (SC).
Mian Dad advocate has filed a constitutional petition in SC making federal government and secretary SJC respondents.
Complete order sheet of former CCPO Ghulam Muhammad Dogar case is attached with the petition. The application regarding objections on Justice Ijaz Ul Ahsan in SJC is also attached with the constitutional petition.
Mian Dad has said the reference of corruption and misconduct against Justice Mazahar Naqvi is pending hearing in SJC.
He further said SJC has issued second show cause notice to Justice Mazahar Naqvi on his complaint. In showcause notice question has been asked from Justice Mazahar Naqvi about three audio leaks. The three audio leaks relate to bench fixing of cases and Ghulam Muhammad Dogar case.
He said Justice Ijaz ul Ahsan was part of the bench which heard the case of Ghulam Muhammad Dogar under bench fixing.
He further stated Justice Ijaz ul Ahsan is member of SJC hearing the matter against Justice Naqvi. In principle and legally any judge who heard Ghulam Muhammad Dogar case cannot become member of SJC. Staying of Justice Ijaz ul Ahsan as member of SJC is against article 9 and 10-A of the constitution and norms of transparency.
It is impression of the complainant and the people Justice Ijaz ul Ahsan will not be able to meet the norms of justice in SJC.
Differing by Justice Ijaz ul Ahsan twice over issuance of show cause notice to Justice Naqvi further strengthens the impression of partiality. The people including the applicant have no expectation of justice from Justice Ijaz ul Ahsan in SJC.
He requested the court to declare the recent inclusion of Justice Ijaz ul Ahsan in SJC violation of article 9 and 10-A of the constitution.
