PESHAWAR: Peshawar High Court (PHC) has declared null and void 80 decisions of Provincial Mohtasib under the Women’s Inheritance Protection Law. PHC maintained in its decision Women Property Rights Act-2019 does not authorize Provincial Mohtasib to order the distribution of disputed property . Justice Muhammad Naeem Anwar issued 90-page written decision. The decision said the complicated disputes related to property come under the jurisdiction powers of civil courts. All the decisions of Mohtasib are in clash with Revenue Act -1967. Mohtasib cannot interfere in pending civil or family cases. The judgment stated that the ombudsperson has no authority to halt judicial proceedings or determine ownership rights. Advocate General KP told the court there are flaws in certain clauses of act. Legal amendment is needed. PHC gave decision Mohtasib can review pending cases as per law but it can not decide them. ONLINE
