ISLAMABAD
Blocking National Identity Card (NIC) of any citizen to implement court’s decision has been declared illegal by Supreme Court (SC).
SC has declared Sindh High Court (SHC) decision null and void. Justice Muneeb Akhtar issued 3-page written order.
The decision said NIC is not a luxury but it is a basic necessity. NIC is not a luxury but it is a basic necessity to spend life. Depriving any one of it is tantamount to snatching right to life. The decision said will the courts issue order to disconnect water and electricity connections tomorrow to return the amount.
Under section 51 of civil procedure there is no room for blocking NIC. No court can block NIC of any one without clear order in the law.
The trial court issued degree for payment of amount against the petitioner in 2016.
Due to non payment of amount the trial court issued order for blocking NIC of the petitioner.
The Sindh High Court too upheld the trial court decision on filing the appeal by the petitioner.
