Petition has been filed in Supreme Court (SC) seeking removal of justice Khadim Hussain judge of Federal Shariat Court (FSC) from his post. The petition was filed by advocate Asad Navid Bhatti making federal government and Justice Khadim Hussain respondents. The petitioner has requested SC to remove Justice Khadim Hussain from his post. The petitioner also requested the SC to nullify notification on granting extension in service to Justice Khadim Hussain. The decisions issued following the extension in service of Justice Khadim Hussain be too declared illegal.
The petitioner has taken plea that as per article 203 judges are appointed in Shariat court for 3 years. President can grant extension to judge of FSC.
The petition said the service tenure of Justice Khadim Hussain has expired in March 2024. One year extension was granted to Justice Khadim Hussain on March 19, 2024. Justice Khadim Hussain is continuing his work without oath after extension in service and he is working as judge illegally.
