SC nullifies clauses 74, 75 of Sindh local govt act

Supreme Court (SC) has nullified clause 74 and 75 of Sindh Local government Act.
The court has announced reserved judgment on MQM petition regarding local bodies power in Sindh. The judgment was reserved in October 2020,
Chief Justice of Pakistan (CJP) Gulzar Ahmad announced the judgment Tuesday.
The court remarked local government comes into being under article 140. The local governments enjoy local bodies powers under local government powers. The financial, administrative and political powers should be ensured for local government under the constitution. It is binding on Sindh government to maintain good working relationship with local governments.
The SC while declaring clause 74 and 75 of Sindh local government act null and void has ordered that Sindh government should harmonize all the laws with article 140-A. Provincial government can launch no new project which comes under the local government. Framing master plan and implementing it are the pow3ers of local governments. Sindh government is bound to set up empowered local bodies.
The SC disposed off the MQM petition in Local bodies powers case.
