SC sends case related to “shufa” to constitutional bench

ISLAMABAD: Supreme Court (SC) has sent case related to “shufa” ( right of preemption ) to constitutional bench. Newly appointed Chief Justice of Pakistan (CJP) Yahya Afridi has said policy has been given to registrar office with reference to constitutional cases. Office has been directed a separate category be formed of the cases wherein any law has been challenged. We will continue to transfer the cases where interpretation of law is needed. He gave these remarks on Thursday. A 3-member bench of SC presided over by newly appointed CJP Yahya Afridi took up the case for hearing.
Justice Shahid Wahid remarked in this case interpretation of the constitutional clauses will have to be made. Case should be transferred to constitutional bench now.
Counsel Suleman Aslam Butt said I did not want to say this. But it should be done so.
