Sindh High Court (SHC) has ordered to remove hindrances on the way of foreigners returning to their respective countries.
The case regarding hindrance in the return of Bangladeshi citizens to their country who are settled in Pakistan came up for hearing in SHC constitutional bench.
The court issued directives to remove hindrances in return of foreigners to their respective countries.
The counsel took the plea in the court that the petitioners have obtained travel permit from high commission on Bangladeshi documents. FIA, Immigration authority are not allowing the petitioners to depart.
The petitioners are facing harassment in making contact with the concerned institutions for obtaining NOC. The petitioners want to go to their country on permanent basis.
The state counsel told the court during the hearing of the case verification of travelling documents of the petitioners from foreign ministry is must. Registration of the petitioners will be checked from NADRA and their national identity cards will be blocked.
Under foreigners act permission for travelling to the petitioners can be given after completion of all legal proceedings.
Justice Adnan ul Karim Memon remarked the basic rights for travelling abroad are linked to restrictions and legal proceedings. The court cannot ignore legal procedure of immigration clearance , identity and deportation in constitutional powers. Completing proceedings by respective institutions in the presence of permission for travelling is their responsibility.
The court remarked unnecessary hindrance be not created in the return of the petitioners to their homeland. The process of return of the petitioners to Bangladesh or deportation be completed soon as per law. The petitioners should provide documents for verification of their identity.
