Islamabad High Court (IHC) Chief Justice (CJ) Athar Minallah has remarked state institutions carve out their niche through their character.
Tweets can make what difference for institutions, he gave these remarks during the course of hearing of one Mariam Malik PTI social media activist petition against FIA notice here Thursday.
The CJ IHC remarked so much lies are there on social media. It was written about me that I have acquired flat. May be Mariam Malik too has written this thing about me. How much criticism is coming for me. Can this then affect my freedom. The institutions carve out their niche through their character.
FIA presented controversial tweets of Mariam Malik in the court.
The court directed Mariam Malik to appear before FIA and record her statement.
The court ordered Mariam Malik to review her presumptions and go to FIA after reading the constitution. Mariam Malik appeared in the court along with her counsel Imaan Mazari.
Deputy Attorney General (DAG) Khawaja Imtiaz appeared on behalf of federation while additional director represented FIA in the court. The court inquired from Mariam during the hearing of the case is it your tweet.
Mariam told the court she does not know FIA has objection over any of her tweet. The court remarked “ you should be aware of it what has happened in the parliament has it happened as per constitution. Do you know what is constitution The state runs on the constitution. If something occurs in the parliament then how can you raise objection. No one cares for the constitution here. DAG told the court Mariam Malik has tried to foment chaos in the society from her twitter account.
Justice Athar Minallah remarked the institutions are in fact due to the people. Some people do it due to lack of knowledge. He is unaware who does not know about the constitution. You will make it offence and FIA will go after him. The state has so many other jobs. These institutions are far above these tweets. No treason takes place due to some one tweets or bidding. They are rendering sacrifices for this country. You should be proud of Pakistan army which is rendering sacrifices of their lives. It will make no difference to this institution due to some one tweets. FIA told the court this is one tweet but tweets like this are coming from her twitter account permanently
The CJ IHC while addressing FIA remarked how much lying is on social media then will you go after all. If I am scared due to what has been written about me then it will be violation of my oath. IF public office holder gets scared due to social media then it will also be violation of their oath. FIA said they have sent only one notice. She should come and record her statement. The court extended its order for not harassing PTI social media activist by FIA till June 24. The hearing of the case was adjourned till June 24.
