Five judges of Islamabad High Court (IHC) have challenged different administrative steps of Chief Justice (CJ) IHC Sarfraz Dogar in Supreme Court (SC).
A petition has been filed in SC under article 184 (3) of the constitution taking the plea no petition for restraining judge from performing judicial work is maintainable in high court. Any judge can be restrained from performing duty only under article 209 . CJ can constitute bench only under the rules framed under article 202. The doctrine of master of roster has already been nullified by SC .
The petition said the February 3 and July 15 notification regarding administrative committees be declared null and void. The recent rules of the IHC be declared illegal. High court cannot issue writ to itself under article 199.
It should be maintained that administrative powers cannot dominate judicial powers. CH is not competent to bring any change in constitution of bench or separate any judge from roster as per his will. CJ cannot restrain any judge from performing judicial duty on his own will.
CJ IHC, Registrar IHC and state have been made respondents in the petition.
This petition was filed by five judges on Friday in SC. These judges are Justice Tariq Mehmood Jahangiri, justice Mohsin Akhtar Kayani , Justice Babar Sattar, Justice Saman Rafat and justice Sardar Ejaz Ishaq Khan.
