LAHORE: Lahore High Court (LHC) has remarked every dishonored cheque is not criminal case unless the ill intent is proved. Justice Sadaqat Ali Khan of LHC while accepting review appeal of Shamim Aslam declared the sentence of 3 years and fine Rs 20000 awarded by trial court null and void. The decision said cheque bounce related case was registered with the delay over one year. No cogent reason was given for delay. The plaintiff of the case has not filed any civil case for recovery of amount. Had the amount been payable then the civil court would have been approached. The court remarked the benefit of doubt is basic right of the accused. The court while declaring the sentence of 3 years and fine null and void acquitted the accused. ONLINE
