Missing person case

Justice Mohsin Akhtar Kiyani has remarked if cheque is not given to affected family then funds of federal government will be freezed.
He further remarked our objective is this the problem is resolved without putting the government into difficulty. People make problems as problem of their small prestige.
He gave these remarks during hearing of contempt of court case on non appointment of chairman missing persons commission and non issuance of cheque of Rs 50 lac to affected family in connection with petition filed by Zainab Zaeem seeking recovery of her missing husband Abdullah Omar.
Justice Mohsin Akhtar Kiyani took up for hearing recovery of missing citizen and contempt of of court case Tuesday.
Additional Attorney General Rashid Hafeez and Assistant Attorney General Usman Ghumman appeared in the court. Khalid Abbasi advocate represented petitioner in the court.
The court gave time to government to appoint new chairman of missing persons commission till July 15.
The court also gave last chance to government for issuing Rs 50 lac cheque to affected family within two weeks.
Additional Attorney General said new chairman of missing persons commission will be appointed within two weeks. Nominations have been made in connection with appointment of new chairman and names have been sent to cabinet.

Justice Mohsin Akhtar Kiyani without mentioning name of former chairman of missing persons commission Justice (Retd) Javed Iqbal said government has already not provided justice by appointing former judge of Supreme Court as chairman of missing persons commission.
Justice Mohsin Akhtar Kiyani remarked the commission established for recovery of missing persons did injustice by not providing justice. Judiciary was too part of it in this job of not providing justice. In this case court has declared the citizen as missing person.
He remarked government should realize that affected family should know its family member is alive or not.
Unfortunately government is not serious in the matter of recovery of missing persons. It feels like this that problem related to recovery of missing person will never be resolved. The cases of missing persons are pending hearing since 15 years.
The court while turning to additional attorney general said it should be told to government courts are not bound to any one. New chairman will come. If he resigns then a new chairman will come. Then new chairman will come and he will say work has to be started from beginning.
Justice Mohsin Akhtar Kiyani inquired we had said for camera briefing in this case last time. What happened about it. Secretary defence should tell what was done about camera briefing. If he does not want to tell then he will have to prove.
Justice Mohsin Akhtar Kiyani said if court’s order is not implemented then contempt of court proceedings will be initiated against respective defence and interior secretaries.
The hearing of the case was adjourned till July 15.
