IHC issues detailed decision, declares Omar Ayub petition non maintainable

ISLAMABAD
Islamabad High Court (IHC) has issued detailed decision on the petition of PTI leader Omar Ayub against NA-18 Hari Pur Election rigging case.
Acting Chief Justice (CJ) Sarfraz Dogar of IHC issued 6-page decision.
The court has maintained the petition of Omar Ayub is not maintainable before this court. The court made it clear it is not giving any finding on the merit of case.
IHC ordered Election Commission (EC) to give decision on the petition against Omar Ayub as per law and move forward the proceedings after hearing the respondents.
The court has lifted July 2024 stay order which was issued to stop EC proceedings on Omar Ayub petition.
It has been further said in the stay order in the opinion of the court this decision has to be made by the court and if the petitioner is affected by this decision then he can file appeal plea in Supreme Court (SC).
The court directed EC to give decision as per law after giving full right of hearing to the respondents.
Order has been issued to send copy of decision to EC so that it could move the proceedings forward by issuing notice.
According to decision Omar Ayub had challenged EC July 10 order for investigation into the rigging in polls.
The court while issuing stay order had stopped EC proceedings.
Omar Ayub was of the view EC has to decide on petition within 60 days. According to him the proceedings of EC is illegal after lapse of 60 days.
It is pertinent to mention here rival candidate of Omar Ayub has resorted to EC for investigation into polls rigging in NA-18 Hari Pur.
