Islamabad High Court (IHC) has has reinstated chairman Pakistan Telecommunication Authority (PTA) Maj Gen (Retd) Hafeez ur Rehman .
IHC suspended Justice Babar Sattar decision for removing chairman Pakistan Telecommunication Authority (PTA) from his post.
A division bench of IHC comprising Justice Muhammad Asif and Justice Inam Amin Minhas took up for hearing intra court appeal against removing chairman PTA from his post Thursday.
PTA, Federation and sacked chairman had filed intra court appeal pleas.
Qasim Wadood, counsel for chairman PTA Maj Gen (Retd) Hafeez ur Rehman, Additional Attorney General (AAG) and others appeared in the court.
Suleman Mansoor counsel for chairman PTA said while arguing that such relief was given which was not requested in the petition. Neither rules were challenged nor was notice issued to Attorney General (AG) before removing chairman PTA. Issuing notice to AG was must.
Counsel Suleman Mansoor said the plea which has not been made in petition cannot be seen in article 199. Court itself wrote the entire debate has not been completed so far.
Justice Muhammad Asif while moving to counsel said he was given much opportunity.
The counsel said 2 applications were also filed in regard to objections but the decision was reserved without seeing them. The arguments were yet to be given on the objections related to maintainability of the petition.
When counsels were on leave the judgment was reserved saying hearing is complete.
Additional Attorney General (AAG ) Rashid Hafeez advocate said while giving arguments that there was competition among 64 persons in Pakistan. 24 candidates qualified among them. Criterion of ability was implemented sternly. No candidate came in the court. Change was made in rules with the approval of federal cabinet before advertising the post.

It is pertinent to mention here justice Babar Sattar while accepting plea against Chairman PTA had announced the order of removing him from his post.
Justice Babar Sattar had issued 99-page judgment. It was said therein that appointment of chairman PTA is not correct legally. Therefore, he be removed from his post immediately.
