Islamabad High Court (IHC) while announcing decision in attempt to murder case has rejected bail after arrest plea of the accused Fawad alias Mani.
Justice Khadim Hussain Soomro while releasing the decision of the case maintained if trigger is pressed once and bullet hits the target then the aim of the accused becomes clear. The accused cannot make his flawed shooting basis for bail.
The court maintained while taking into account the available evidence and gravity of offence the accused is not entitled to the bail.
According to written decision of the court the accused is charged with injuring wife and son of the plaintiff by opening fire on them
During the investigation the pistol which was used in the offence was also recovered from the possession of accused.
The court wrote in its written decision shifting the injured to hospital first is a natural process. Delay of some hours makes no difference in case.
According to police file there are already four other cases registered against the accused Fawad alias Mani. The court remarked the material available in record is enough to link the accused to the offence.
Therefore, he is not entitled to bail.
The court remarked these observations are of temporary nature. Trial court should not be influenced by them while giving decision on merit.
