SC acquits 3 accused in murder case after 15 years

Supreme Court (SC) while declaring Lahore High Court (LHC) January 09, 2017 decision null and void has acquitted 3 accused in murder case after 15 years.
A 3-member bench of SC comprising Justice Hashim Kakar , justice Salah ud Din Pinhore and Justice Ishtiaq Ibrahim took up the case for hearing.
Justice Ishtiaq Ibrahim issued 10 pages written order for acquittal of the convicts
It has been said in the written order SC acquitted Munir Ahmad, Zulfiqar alias Kala and Nasir Ahmad from murder case.
The murder incident had taken place in district Lodhran on December 17, 2010 where Ghulam Sardar was gunned down.
SC said in the written decision trial court had declared the accused guilty of murder and awarded death sentence to 2 accused and life imprisonment to one accused.
However LHC upheld the life imprisonment of the one accused. Later LHC converted death sentence of two accused into life imprisonment.
As per SC the prosecution failed in proving the crime. The presence of the witness on place of crime was not proved. Grave contradictions were found in the statements of the witnesses.
The SC also declared the witnesses occasional.
It was said in the decision that medical report did not support fully to eye witness testimony. The recovery of arms and empty shells is not reliable.
The accused are acquitted by giving them benefit of doubt.
