11-member bench of Supreme Court (SC) hearing reserved seats case stands dissolved.
Justice Salahuddin Panhwar who is member of this bench recused from hearing the case.
Hearing of the case was underway under Justice Amin ud Din Khan . However at the inception of hearing Justice Salah ud Din Panhwar recused from becoming part of the bench saying objection has been raised on his inclusion in the bench.
Justice Salah ud Din Panhwar remarked the trust of people on judiciary is must. It is necessary no respondent has objection over bench. Hamid Khan raised objection over inclusion of some judges in the bench. The judges whose inclusion in the bench after 26th amendment was objected I am among these judges too
I can not further sit in the bench due to these reasons. I want to read my short decision.
Justice Salah ud Din Panhwar said to Hamid Khan your objection was over my sitting in the bench. Personally my association with you stands since 2010. I was personally hurt due to your arguments.
Faisal Siddiqui and Suleman Akram Raja like lawyers expressed confidence on judges.
But the way objection was raised, it raised question on dignity of court. Therefore, I am recusing from bench from hearing the case for the sake of dignity of institution.
He made it clear his recusing from hearing the case be not taken as acknowledgment of some objection.
Advocate Hamid Khan who was present in the court declared the decision appreciable.
However Justice Amin ud Din Khan said this is not matter of appreciation. we are hearing other lawyer of Sunni Ittehad Council in this case.
Justice Jamal Mandokhail while moving to Hamid Khan said this all has taken place due to his conduct. . 2 lawyers of a party are not entitled to give argument even then we gave you chance to ague.
Hamid Khan said he has right to give arguments in this case on the basis of review.
Justice Jamal Mandokhail said you were not entitled to give arguments in this case.
During hearing Justice Salah ud Din Panhwar further said I was personally hurt due to your arguments. But here the matter is not my person. Allegation of partiality was leveled on judges which hurt me. Going this impression to public that judge is partial is not correct.
