SC constitutional bench returns two cases to regular bench

ISLAMABAD: Supreme Court (SC) constitutional bench while returning two cases to the benches hearing regular cases has remarked every case like these be not sent to constitutional bench and a case wherein any constitutional question arises be sent to constitutional bench. These remarks were given by Justice Muhammad Ali Mazhar with reference to two cases referred by a 3-member bench led by Justice Mansoor Ali Shah to constitutional bench. A 7-member SC constitutional bench presided over by Justice Amin ud Din Khan heard Saeed Khosa versus ministry of petroleum case. The counsel for the petitioner took the plea a 3-member regular bench had sent the case to constitutional bench. Justice Ayesha Malik remarked I was part of regular bench. The case was sent to constitutional bench on the request of counsel. Justice Muhammad Ali Mazhar remarked every case like this be not sent to constitutional bench. If any constitutional question arises in any case then it be sent to constitutional bench. The court sent the case again to regular bench. A 3-member bench presided over by justice Mansoor Ali Shah had sent the case to constitutional bench on October 23. Second case related to housing society which was returned by constitutional bench to regular bench. Orders have been issued for fixing these cases again before regular bench for hearing. APP
