ISLAMABAD
Supreme Court (SC) has dismissed the petitions against holding MDCat tests again in KP and Sindh. The court has upheld the decision of high court for holding MDCAP tests in KP and Sindh.
A 3-member bench of SC presided over by Justice Yahya Afridi took up the case for hearing Friday.
Peshawar High Court (PHC) had declared it mandate of provincial government to hold MDCAT test again due to matter of cheating.
Several lawyers including Habib Ullah Qureshi appeared in SC and gave arguments.
However the court said the system has deteriorated due to cheating by the students who have appeared in the examination therefore, it is must that the examination be held again.
The court further remarked secondly it is policy matter wherein court cannot interfere. The lawyers said upon it PHC has too interfered in it. Then how can that decision be upheld.
SC remarked we do not want to interfere when two days are left in holding test.
The lawyers took the plea 40000 people have been affected. Papers are taken of five kinds. They are not similar. One paper has been leaked. Paper has been leaked in Larkana and not in Karachi.
On the other hand PMDC counsel said in the court forensic of two mobile phones was done. This proved that the paper has been leaked. Inquiry committee and Provincial cabinet said to PMDC test will take place again.
The counsel for petitioner said during the hearing that test date be advanced for two months instead of holding it on November 19.
The court did not agree to counsels arguments and dismissed the petitions.
The students have said no good has been done to them. They had passed examination with so much difficulty and hard work. They are making consultation to file review petition in this case.
Final decision to file review petition will be made when detailed decision is received.
