SC nullifies LHC decision on Election Tribunals in Punjab

ISLAMABAD: Supreme Court (SC) has given big relief to Election Commission (EC) in connection with hearing of election petitions under tribunal. Announcing the decision regarding case of formation of election tribunals in Punjab SC has accepted appeal plea of EC besides nullifying LHC decision. . SC has remarked in its decision the Lahore High Court (LHC) single bench decision cannot be presented as precedent. Judge of LHC did not keep in view non holding of meeting between chief justice and Chief Election Commissioner. Had non holding of meeting been kept in view then such decision would not have been made. Chief Justice of Pakistan (CJP) Qazi Faez Isa read out decision. The SC while accepting appeal plea of EC regarding constitution of election tribunals declared LHC single bench June 12, 2024 decision null and void. A five members bench of SC presided over by CJP Qazi Faez Isa had reserved judgment after completing the hearing of the case. The court read out decision on Monday. The court remarked when the dispute relates to constitutional institutions then cautious attitude be adopted. ONLINE
