KARACHI: Sindh High Court (SHC) while rejecting the bail plea of one Ejaz accused in raping his minor daughter has maintained prima facie the statement of aggrieved girl seems to be reliable and natural. No such material is available on record which gives indication on implicating father in false case or any ill intention behind this proceedings. As per media report the defence counsel took the plea during the hearing of the case the case is false and is outcome of domestic deputes. He said this plaintiff contracted third marriage with the accused and the differences emerged later in regard to the pledges made at the time of marriage. ONLINE
The defence counsel further said the medical evidences also don’t support the allegations against the accused.
Justice Omar Sial while expressing resentment over the arguments of the defence counsel said these arguments are tantamount to making bid to prove the shock of the girl insignificant.
The court also maintained disparaging remarks have been included in the bail plea about the second marriage of the plaintiff.
The court said in remarks more sensitivity is expected from women lawyers with reference to women problems and sensitive nature cases.
The court observed the statement by the girl apparently seems to be reliable and natural while her attitude and behavior conform to such children who have passed through tragedy.
