ISLAMABAD: Two more intra court appeals have been filed in Supreme Court (SC) against court decision in judges seniority case. The number of appeals filed in this regard now stands at 4. The appeals have been filed by Karachi Bar and Shoaib Shaheen whereby it has been requested that June 19 decision in judges seniority case be declared null and void. The petitioners have taken the plea in the appeals SC has not correctly interpreted the constitution. SC derived word of permanent transfer itself in article 200. There is no concept of permanent transfer in the constitution. The appointment on the posts of judges is possible only through Judicial Commission (JC). Maintaining this by SC that appointment can be made on post through transfer runs contrary to constitution. Determining the seniority of judges does not fall in the powers of president of Pakistan. Earlier two intra court appeals were filed which have not been fixed for hearing so far. Lahore High Court Bar and Lahore Bar had filed separate appeal pleas against SC judgment in judges seniority case. They had prayed the SC to nullify the 5-member bench decision. It has been requested in appeal pleas to suspend the decision of five members bench and steps taken in the light of this decision till the decision of appeals.
The petitions said the court has given decision without making full review of the matters according to constitution. Therefore, this decision be reviewed.
It was further said we have not been fully heard and decision has been made in haste.
