Chief Justice of Pakistan (CJP) Umar Ata Bandial has remarked we will have to see who was financing Arshid Sharif after he had left Pakistan and gone to Kenya.
He further remarked what material was kept before Arshid Sharif due to which he had to leave Pakistan. Several cases were registered against Arshid Sharif in Pakistan. Who was behind these cases. The facts will come to open when all the links are connected.
He observed who wanted to get rid of Arshid Sharif. Kenya is a sovereign country. We should pin blame on any one.
He said we have to see this if the special JIT has conducted correct investigation in Kenya and UAE. Was special JIT prepared for investigation. Some mistakes have been committed in Pakistan and abroad in Arshid Sharif murder case. The fact finding committee report was issued why and on whose stance. The accused became alert following the issuance of this report.
He remarked has the Special JIT conducted investigation on all the points which had come to open in fact finding report and inquiry. Special JIT has sought assistance of what foreign agencies. Some thing wrong has happened during contacting Kenya and going therein. Ascertaining information about it is the responsibility of foreign office.
He gave these remarks while presiding over 5-member larger bench of Supreme Court (SC) during the course of hearing of suo motu notice of Senior journalist Arshid Sharif murder case Monday.
Additional Attorney General (AAG) Amir Rehman told the court two separate reports in respect of Arshid Sharif murder case have been filed in the court. One report is from foreign ministry and second report is from special JIT.
Informing the court about the progress so far achieved in Arshid Sharif murder case the AAG said Kenyan authorities have not given access to special JIT to the crime scene. Kenya has provided to us mutual legal assistance so far.
According to Kenyan authorities legal proceedings has been started against the two Kenyan police officers who had opened fire on Arshid Sharif. AAG also told that special JIT is not allowed to investigate any one in UAE. It has been written to Interpol for issuance of red warrants about Khurram and Waqar , two major characters in Arshid Sharif murder case.
IG Owais, head of special JIT told the court no material has been provided to us so far about Arshid Sharif murder. Kenyan authorities are not cooperating with us.
The CJP remarked we give you one month time. Give us complete report how can we go ahead in Arshid Sharif murder case. Hire lawyer in Kenya. Get information about your legal rights. Take one month. DO what you can do but you should reach the facts.
The court while adjourning the hearing of the case till March 2023 has summoned progress report within two weeks from special JIT.
