ISLAMABAD, Nov 04 (Online): Justice Amir Farooq of Islamabad High Court (IHC) has remarked “ don’t play hide and seek with the court as such things are of no use.
The court rejected the plea seeking stay order against the proceedings in disqualification case against federal minister Faisal Vawda here Wednesday.
Justice Amir Farooq remarked “ I will not grant stay at any cost. We will decide the matter after seeing the record of election commission.
Justice Amir Farooq gave these remarks while hearing disqualification case in respect of Faisal Vawda here Wednesday.
At the inception of hearing of the case counsel for Faisal Vawda filed the petition seeking staying the proceedings of the disqualification case forthwith.
He said that 4 petitions are pending hearing in election commission.
Barrister Jahangir Jadoon said they say before the election commission that the matter is running in high court too.
The court inquired from counsel of Faisal Vawda “ have you field the reply. Why did you not attach order sheets of election commission with the petition. You are not appearing in the election commission too. Election commission has said in the court Faisal Vawda has given affidavit with the record to the effect that he does not hold dual nationality. We will give the decision after seeing the record.
The court while expressing annoyance over non filing of reply by Faisal Vawda remarked we had given clear orders that reply be filed. Then why the reply has not been filed.
Justice Amir Farooq remarked “don’t play hide and seek with the court. Your are neither appearing before election commission nor are appearing before court. You are not appearing there and are doing the same thing here.
Counsel for Election commission told the court the affidavit given by Faisal Vawda of not holding dual nationality has been presented in the court with the record.
Barrister Jahangir Jadoon told the court that their case is this Faisal Vawda was having dual nationality at the time of filing nomination papers. The application for abandoning foreign citizenship was accepted later on June 25, 2018.
Justice Amir Farooq remarked it means when affidavit was filed then he was US national.
The counsel for Faisal Vawda told the court they have objection over authenticity of this document.
Justice Amir Farooq remarked we are issuing notice to you repeatedly for this reason that you should file reply that if you want we should issue notice to Faisal Vawda and summon him here.
Counsel for election commission told the court record which has been filed in this court was obtained from office of returning officer Karachi. Faisal Vawda had said in his affidavit he does not hold foreign citizenship and he had not applied for it ever before.
Counsel for Faisal Vawda prayed the court to give him some time to seek directives from his client.
Justice Amir Farooq while addressing counsel for Faisal Vawda remarked don’t put your client in difficulties. Talk clearly and straightforwardly with the court.
The counsel for Faisal Vawda told the court that he would assist the court after obtaining instructions from Faisal Vawda.
The court while accepting plea from counsel of Faisal Vawda adjourned the hearing of the case till November 12.
