LAHORE: Section 4 of Supreme Court (SC) Practice and Procedure Act has been challenged in Lahore High Court (LHC). Federal government, president Arif Alvi has been made respondents through principal secretary in the petition filed by Mashkoor Hussain through Nadim Sarwar advocate. The petitioner has taken the plea the supreme court practice and procedure act have become act after having been approved from both the houses of parliament. Through section 4 of the act right to appeal against suomotu decision has been given. The petitioner took the plea granting right to appeal against suo motu decision runs contrary to article 184 and 185 of the constitution. The right to appeal can be given only by making amendment in articles 184 and 185. The petitioner has requested the court to nullify section 4 of supreme Court practice and procedure act besides stopping the implementation of section 4 till the decision of this case. Online
