Federal Constitutional Court (FCC) has remarked tribal leader ( tribal sardar) is not authorized to attest national identity card and domicile.
FCC has issued a major decision on sardari nizam and attestation of national identity card.
As per media report a 2-member bench of FCC under Justice Amir Farooq has issued 12-page decision.
The court while issuing decision remarked national identity card and domicile are issued as per law.
In the law the competent authorities have been empowered to attest the documents related to identification.
According to FCC, no tribal leader can be empowered to attest the documents beyond law.
As per law the sardari system has been abolished in 1976. The sardari system in tribes is regional tradition. It has no legal standing . No judicial endorsement of regional tradition can be made.
The applicant is not aggrieved party. Therefore, the appeal is not maintainable.
According to the petitioner Ghulam Ali is chief of Kharoti tribe.
According to petitioner it is impossible process for the people of his tribe to get attest documents.
The only aggrieved person is eligible to resort to court.
The chief of Kharoti tribe of Balochistan Sardar Ghulam Ali had filed appeal against the decision of Balochistan High Court.
