ISLAMABAD: Federal Constitutional Court (FCC) while giving big relief to corporate tax payers has declared adjustment of tax credit against super tax legal besides approving appeal pleas of private mobile company. Justice Amir Farooq authored 6-page detailed decision. It was maintained in the decision that tax credit available under section 168 of income tax ordinance is separate and legal right. Pushing tax payer to seek refund by stopping him from exercising this legal right runs contrary to law. FCC maintained financial laws should be interpreted keeping in view the benefit and facility of tax payer . The court directed FBR to review adjustment claim filed by tax payer and give decision as per law in reply to notice. FBR had issued notice to private mobile company for payment of super tax. DNA
