Supreme Court (SC) has reserved judgment about determination of amount of diyat in murder case.
Justice Hashim Kakar remarked there are basically three questions in the case that amount of diyat will be determined from the time of incident or time of arrest or time of conviction.
A 3-member of SC presided over by Justice Hashim Kakar took up for hearing appeal plea filed by the culprit Nadim Khan.
The counsel for the convict told the court that his client has completed his sentence and he is serving sentence for not paying arsh money.
Prosecutor KP Arshid Hussain said this is first case of its nature. The decision of high court is there regarding determination of money. According to it the diyat money stands at Rs 19700000. Justice Salah ud Din Panhawar said if murdering becomes more costly a bit then the people may stop perhaps.
Giving example he said 100 camels are given against diyat in Saudi Arabia at present too.
Justice Ishtiaq Ibrahim remarked not taking decision on time is flaw in system but punishment of flawed system cannot be given to accused.
Prosecutor Arshid Hussain took the plea the determination of age of the accused is made from the time of arrest.
The court directed all prosecutors to file written submission on this matter.
